GRAMMATICAL PECULIARITIES OF INTERNATIONAL LAW DOCUMENTS RENDERING

Abstract

The article is devoted to the translation of international law documents, in particular twenty-five articles of the Council of Europe Convention on the Protection of Human Rights and Fundamental Freedoms, the Ukrainian version of which is posted on the official website of the Supreme Council of Ukraine. Translation of such texts should be accurate and concise. Translation transformations help to achieve the adequacy of translation. The author analyzes the national and foreign approaches to the classification of grammatical transformations and concludes that scientists treat types of grammatical transformations differently. Grammatical replacements, permutations, omissions and additions belong to grammatical transformations. The conducted research is based on Ukrainian scientist S. E. Maximov’s classification of transformations. They are zero translation, permutation, replacement, addition and omission. The author of the article presents the results of the practical research. 355 grammatical transformations in the Ukrainian translation of the Convention articles have been studied. Different types of replacements (202 examples – 57%), additions (63 cases – 18%), permutations (53 examples – 15%) and omissions (23 examples – 16%) have been analyzed in the translation. The permutations were used quite often; however, they were usually combined with different kinds of grammatical substitutions. The fewest examples were those of zero translation (14 examples = 4%). There are very few cases when the interpreter did not use any transformations. That was the case with Convention articles headings translation. The author notes that the translation of international documents is a complex process; the wide application of grammatical transformations is explained by the differences in the grammatical structure of English and Ukrainian.
